WHEREAS, the majority of the property holders, according to the numbers of owners, assessed valuation and area, owning property situated in Talamore-Stonebriar Suburban Road Improvement District No. 8 of Benton County, Arkansas (the "District"), petitioned the County Court of Benton County, Arkansas, to form a suburban road improvement district to be organized for the purposes of maintaining and improving the streets, roads and storm drainage within the District, and for all other related purposes authorized by law, specifically including but not limited to those intents and purposes stated in Arkansas Code Annotated Sections 14-92-101 et seq., together with facilities related to any of the foregoing within the District, to serve the inhabitants of the District; the purposes to be accomplished in the manner and of the materials that the Commissioners of the District deem to be in the best interest of the District, and the cost thereon to be assessed upon the real property in the District according to the benefits received; and
WHEREAS, the Benton County Court established the District to accomplish the above purposes by entering its Order on December 10, 2013; and
WHEREAS, the assessments have been duly made by the Assessor of the District, who was appointed by the Board of Commissioners of the District, and filed in the office of the Benton County Clerk pursuant to law, and notice of such filing was duly mailed to each property owner in the District and published in the Daily Record, a newspaper published in and of general circulation in the County of Benton, Arkansas, on December 11, 2013 and December 18,2013; and
WHEREAS, on December 27, 2013, Commissioners and Assessor for the District met at the place and time named in said notice as a board of equalization and heard all complaints against the assessments filed with the County Clerk, and equalized the same; and
WHEREAS, after some minor adjustments, the District assessed benefits of $5,373,114.00 with a rate of levy of 3.5% and an annual assessment of $188,059.00; and
WHEREAS, the benefit received by each and every block, lot and parcel of real estate situated in the District equal or exceed the local assessments thereon; and
WHEREAS, the presently estimated cost of improving and maintaining the improvements to the District is $1,375,000.00 exclusive of capitalized interest and costs of financing; and
WHEREAS, the assessed benefits (the "Assessed Benefits") amount to $5,373,114.00.
NOW, THEREFORE, BE IT ORDERED by the Board of Commissioners of Talamore-Stonebriar Suburban Road Improvement District No. 8 of Benton County, Arkansas:
Section 1. That each of the blocks, lots and parcels of real property in the District be assessed according to the assessment list of the District, as equalized, as the same now is of record in the office of the Benton County Clerk, and the Assessment of Benefits on each of the blocks, lots and parcels shall be collected by the Benton County Collector with general taxes becoming due in the year 2014 and annually thereafter at the rate of levy per annum of 3.5% until the whole of the total assessment, with interest thereon at a rate equal to the lesser of the maximum rate permitted by law or the rate of 10% per annum, shall be paid; and, thereafter in amounts to be determined as necessary to maintain, repair, replace and improve the District's streets, roads and storm drainage, and related facilities.
Section 2. This Order shall have all the force of a judgment to be paid by the real property in the District in proportion to the amount of the Assessed Benefits as established herein and to be paid in annual installments as set forth in Section 1 hereof and the taxes so levied shall be a lien upon the real property in the District from the time of the date of this Order and shall be entitled to preference over all demands, executions, encumbrances or liens whatsoever created, and continue until all such assessments, with any penalty or cost that may accrue thereon, shall have been paid.
Section 3. This Order shall be in full force and effect from and after its entry.

AN ORDINANCE CHANGING REAL ESTATE IN THE CITY OF BENTONVILLE, ARKANSAS, FROM ITS PRESENT CLASSIFICATION TO R-1, SINGLE FAMILY RESIDENTIAL.
WHEREAS, First Assets Holding, LLC, duly filed a petition with the City Planning Commission requesting that the hereinafter described real property situated in Benton County, Arkansas, be changed from its present classification to R-1 property to be used in accordance with city zoning laws and state laws; which property is described as follows:
Lots 46 and 47 of Cornerstone Ridge Subdivision Phase IV as shown in plat record 2006 at page 344 as filed in the office of the Benton County Circuit Clerk, Bentonville, Arkansas.
WHEREAS, the City Planning Commission duly met and considered the application and duly set the petition for public hearing to be held the 3rd day of December 2013 in the Council Room of the City of Bentonville; notice of said hearing having been published in the Benton County Daily Record for the time and in the manner required by law; and
WHEREAS, the City Planning Commission voted to recommend to the City Council that the petition be approved and that said property be rezoned from its present classification to R-1 property;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF BENTONVILLE, ARKANSAS:
Section 1: That the above described real property is hereby changed from its present classification to R-1 property to be used in accordance with the City zoning laws of the State of Arkansas.
