ACTIONS
Public notice is hereby given that the Arkansas Department of Environmental Quality (ADEQ) has entered into the Consent Administrative Orders and has issued the Notices of Violation listed below. Documents for these enforcement matters can be made available for inspection or copying by contacting ADEQ's Legal Division, 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317. There may be a charge to cover photocopying costs for some documents. Copies of enforcement documents, including those referenced in this notice, also are available for viewing on the ADEQ website at http://www.adeq.state.ar.us/legal/cao_info.asp. Further, ADEQ is accepting written comments from the public regarding these matters. Such comments must be sent to ADEQ, Legal Division, at the above address within 30 days after publication of this Notice. If a comment on any proposed Consent Administrative Order is received by ADEQ within this time period, in accordance with Act 163 of 1993, the person submitting the comment may request the Arkansas Pollution Control and Ecology Commission to set aside the order in the matter by filing a petition with the Commission Secretary. If a comment on any Notice of Violation is received by ADEQ within this time period, the person submitting the comment will be given notice of any hearings held on the matter and shall have the right to intervene in any hearing in the matter by filing a petition for intervention with the Commission Secretary. Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Ash Grove Cement Company (41-00001) operates a facility located at 4343 Highway 108, Foreman, AR 71836. This facility has submitted an application to incorporating the recently revised applicable requirements of 40 CFR Part 63, Subpart LLL, incorporating 40 CFR Part 63, Subpart G and Subpart XX applicable requirements, removing decommissioned sources, incorporating the updated Fugitive Dust Plan, correcting particulate matter emission limits for several sources, permitting a clinker transfer chute, and incorporating language of the Permit Appeal Resolution for testing required in Specific Condition 138. The total permitted emission increases include 28.3 tpy of PM and 3.0 tpy of PM10. 27.4 tpy of permitted PM emission increase is due to typographical errors from the previous permit. These increases do not trigger a PSD review.

Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Federal Bureau of Prisons - Federal Correctional Complex (62-00118) operates a facility located at 1301 Dale Bumpers Road, Forrest City, AR 72335. Air emissions from several combustion sources and furniture construction operations are permitted under a minor source air permit. The facility is modifying the permit to include the provisions of 40 CFR Part 63, Subpart CCCCCC for the 12,000 gallon gasoline storage tank located at the facility. In addition, the gasoline tank will now be permitted as SN-030 and removed from the insignificant activities list. Overall permitted annual emissions will increase 0.9 ton of VOC and 0.64 ton of total combined HAPs.

Kinder Morgan Operating, LP - Hickman Bulk Terminal (47-00882) operates a facility located at 7725 County Rd 142, Blytheville, AR 72315. This facility has submitted an application for an initial air permit. Hickman plans to increase coal processing and storage rates to more than 200 tons of coal per day and 220,000 tons of coal per year upon issuance of this initial minor source air permit. No additional equipment is required to meet this rate. Total permitted annual emissions associated with this minor source permit are: 32.9 tpy (tons per year) PM and 10.3 tpy PM10.

Location: drive approximately 0.25 mile east of Monte Ne Volunteer Fire Department on Hwy 94 then turn south into 7th Street, drive pass waterslide, follow asphalt road to wastewater treatment plant on left at the bottom of the hill; Latitude: 36° 17' 41.38" N; Longitude: 94° 3' 1.37" W in Benton County, Arkansas. The discharge of treated sanitary wastewater from a campground is into Monte Ne Cove of Beaver Lake, thence to the White River in Segment 4K of the White River Basin.

Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Graphic Flexible Packaging, LLC (35-00017) operates a facility located at 1701 Jefferson Parkway, Pine Bluff, AR 71602. This facility has submitted an application to renew their title V permit along with several applications to modify the permit. Modifications and revisions addressed in this permit include: use of a defoaming agent for the black liquor at the recovery boiler (SN-02); installation of a new 1,000 gallon storage tank; installation of the No.6 Press, No. 5 Bag Machine, an additional tuber machine, and two slider bottomer machines in the packaging plant; addition of the Wet Strength System to SN-16A-C; addition of a 200,000 gallon storage tank (SN-56); installation of a 2.1 MMBtu/hr natural gas fired boiler (SN-100); permitting the existing 1.0 MMBtu/hr boiler (formerly SN-100) as an insignificant activity; replacement of the East and West White Liquor Storage Tanks (SN-28 and SN-29) with new tanks; addition of an emergency engine (SN-57); updated all federal requirements to comply with most current versions of NSPS Subpart Kb and NESHAP Subparts S, KK, MM, and ZZZZ; and finally the addition of haul road emissions (SN-58 and SN-59). Overall, annual permitted emissions increased 34.4 tons of PM, 5.8 tons of PM10, 3.7 tons of CO, 1.0 ton of NOx, 0.13 ton of chlorine, 0.12 ton of hydrogen fluoride, 1.64 tons of hydrogen sulfide, 0.15 ton of sulfuric acid, and 9.8 tons of TRS. Annual permitted emissions decreased 4.3 tons of SO2, 1,384.8 tons of VOC, 1,381.6 tons of methanol, 40.53 tons of acetone, 5.44 tons of ammonia, and 326.43 tons of other combined HAPs.

Notice of Public Review Period for Arkansas Air Monitoring
Network
Pursuant to 40 CFR Part 58, Subpart B, states are required to submit an annual air monitoring network plan to the US Environmental Protection Agency (EPA). The Arkansas Department of Environmental Quality (ADEQ) will submit Arkansas's plan to the US EPA Region 6 office in Dallas, TX after a 30-day public review period for comments. The public review period will expire on June 30, 2014 at 4:30 p.m.
This network plan is required to provide the framework for establishment and maintenance of an air quality surveillance system for the state. The document includes proposed changes to the Arkansas air monitoring network for Fiscal Year 2014, and represents ADEQ's efforts to effectively protect the health of the citizens of Arkansas through ambient air monitoring using the latest and best technology that is commercially available and to communicate the data collected as quickly and accurately as possible.
The proposed Arkansas plan is available for public inspection on the ADEQ's web site at the following address: http://www.adeq.state.ar.us/air/pdfs/2014_ar_annual_network_plan.pdf. This facility has submitted an application to renew the Title V air permit; update reportable HAPs, emission factors, permit shield, and insignificant activities; incorporate applicable federal regulation provisions of 40 CFR 63 Subpart ZZZZ; Reduce emergency generators SN-10 and SN-12 to 100 total hours/rolling 12 months each; test that natural gas contains 0.2 grains of Total Sulfur per 100 scf of natural gas or less every 60 months; Require one-time Formaldehyde test at the exhaust of one of each type engine; and Require that CO, NOX, and Formaldehyde testing results be extrapolated to correlate with 100% of permitted capacity, defined as 120% of rated capacity. PUBLIC HEARING
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold a public hearing at North Little Rock July 14, 2014, to receive public comments on proposed changes to APC&EC Regulation 6 (Regulations for State Administration of the National Pollutant Discharge Elimination System [NPDES]). The deadline for submitting written comments on the proposals is 4:30 p.m. (Central Time) July 28, 2014.
The hearing will be held in the Commission Room of the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, beginning at 2:00 p.m.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearing. If the hearing is postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period.
APC&EC authority to revise Regulations 6 is found in the Arkansas Code Annotated, Section 8-4-101, et seq.
Proposed changes to Regulation 6 involve the addition of a new section, Reg. 6.207, which would establish public notification procedures whenever an applicant files a Notice of Intent to apply for a General Permit for a Concentrated Animal Feeding Operation under Regulation 6 permitting procedures.

Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air
Division of the Arkansas Department of Environmental Quality gives the following notice:
City of Jonesboro - Yard Waste Facility (16-01044) operates a facility located at 2650 Lacy Drive, Jonesboro, AR 72401. This facility has submitted an application to renew their Title V Air Permit. There are no emission rate limit changes associated with this renewal.
The application has been reviewed by the staff of the Department and has received the Department's tentative approval subject to the terms of this notice.
Citizens wishing to examine the permit application and staff findings and recommendations may do so by contacting ADEQ Air Permits Branch. Citizens desiring technical information concerning the application or permit should contact, Adam McDaniel, Engineer. Comments will be accepted in accordance with Section 8.208 of Regulation #8. During the public comment period, any person may submit written comments to the Department at the
above address Attention: ADEQ Air Permits Branch or to airpermits@adeq.state.ar.us by email. Any interested person may request a public hearing on the draft permitting decision during the public comment period. The public comment period shall begin on the day this notice is published and shall expire at 4:30 p.m. Central Time on the thirtieth (30th) calendar day after publication of this notice.
The Director shall make a final decision to issue or deny this application or to impose special conditions in accordance with Section 8.211 of the Arkansas Pollution Control and Ecology Commission's Administrative Procedures (Regulation #8) and Regulation #26.

Public Notice
Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Tokusen USA, Inc. (23-00244) operates a facility located at 1500 Amity Road, Conway, AR 72032. This facility has submitted an application to remove the Thermal Oxidation Evaporator and update the road emission calculations. With the removal of the Thermal Oxidation Evaporator the facility status will change from a Title V facility to a minor source. Total permitted emissions will decrease as follows: 0.1 tons/year (tpy) PM/PM¬10, 0.1 tpy SO¬2, 3.6 tpy VOC, 1.0 tpy CO, 9.2 tpy NOx, 0.099 tpy Cu, and 0.1 tpy Zn.
