NOTICE OF PERMIT APPLICATION FOR A NEW CONSTRUCTION AND DEMOLITION RECYCLING FACILITY

In accordance with provisions of Arkansas Statutes 8-4-203(b), public notice is hereby given for an administratively complete permit application for a Construction and Demolition Recycling Facility located in the part of the NE˘ of the SW˘ and part of the SE˘ of the SW˘ Section 12 Township 18 North Range 30 West, Benton County, Arkansas. The address of the facility is 721 South Lincoln, Lowell, Arkansas 72745.
The application was received by the ADEQ-Office of Land Resources on February 3, 2016. The name of the applicant is USA Metal Recycling. The proposed CDRF will be used for the sole purpose of recycling construction and demolition materials.
Any interested person may request that the Department hold a public hearing concerning the proposed Class 4 permit Application. Requests must be in writing and must be submitted within ten (10) calendar days of the publication date of this notice. The decision on whether to schedule a public hearing is at the discretion of the Director. If a hearing is scheduled, certified mail notice will be provided to the permit applicant and to all persons who submitted individual written requests for a hearing within this 10-day period, as provided by law.

A second public notice concerning this proposed permit will be published once the Department has made a decision to approve or deny the permit. Upon publication of the second notice, any interested person may submit written comments to the Department regarding the technical and regulatory merits of the proposed permit decision. All comments received will be considered in developing the final permit decision if those comments are received within the comment period designated in the second notice. Other than the permit applicant, only those persons who submitted written comments during that specified comment period, or who make comments for the record at any formal hearing called by the Department regarding this permit application, will have legal standing to appeal any final permit decision.

Container Life Cycle Management LLC (10-00104) operates a facility located at 142 Technology Drive, Arkadelphia, AR 71923. This facility has submitted an application to increase the emissions from SN-01 based on recent stack test results. Additionally, the facility is increasing the solids contents of the paints used in the painting operations (SN-04), increasing the VOC content for the ring dip thinners that are used in the ring dipping operations (SN-03), decreasing the minimum afterburner temperature to 1,500°F, and adding the previously unpermitted emergency generator (SN-06). The total permitted emission increases include 41.5 tpy of PM/PM10, 0.1 tpy of SO2, 17.2 tpy of VOC, 1.5 tpy of CO, 44.5 tpy of NOx, 0.02 tpy of Single HAP, and 0.03 tpy of Total HAPs.

This is to give notice in accordance with A.C.A sec. 8-4-203 that the Permits Branch of the Office of Water Quality of the Arkansas Department of Environmental Quality (ADEQ), 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317 at telephone number (501) 682-0648, has made a decision to not renew the above General Permit, which is set to expire on October 31, 2016, under the National Pollutant Discharge Elimination System and the Arkansas Water and Air Pollution Control Act. APC&EC authority to revise Regulation 19 is found in Arkansas Code Annotated, Section 8-4-301, et seq.
The substantive proposed changes to the Regulation 19 are necessary to comply with federal requirements, which include the U.S. Environmental Protection Agency’s ( EPA) finding that the current provisions are substantially inadequate to meet federal Clean Air Act (CAA) requirements and to address EPA’s State Implementation Plan (SIP) call with respect to applying to excess emissions during periods of startup, shutdown and malfunction provisions published in the Federal Register (80 FR 33840, June 12, 2015). The proposed changes also include the repeal of Chapter 14, Clean Air Interstate Rule (CAIR) Nitrogen Oxide (NOx) Ozone Season Trading Program General Provisions, since it is no longer in effect, and EPA replaced it with the Cross-State Air Pollution Rule (CSAPR), which took effect on January 1, 2015. Other substantive proposed changes include the addition of a definition of “Direct PM2.5 Emissions” and also the addition of t-Butyl Acetate to the list of compounds determined to have negligible photochemical reactivity in the definition of “Volatile organic compounds.”
In general, the proposed changes will help ensure Arkansas has the authority to implement air pollution control programs and to issue permits. Amendments to Regulation 19 will be submitted to the EPA for inclusion into Arkansas’s SIP.

Almatis, Inc. (63-00010) operates a facility located at 4701 Alcoa Road, Bauxite, AR 72011. This facility has submitted an application to renew the current Operating Title V Permit. With this renewal application, Almatis is removing a number of permitted sources and insignificant activities that are inactive or have been removed from the facility. Almatis is also requesting to add a number of sources and one (1) insignificant activity. In addition, Almatis is requesting to implement a bubbled emission rate for annual emissions of NOx from four combustion sources in order to allow some operational flexibility. Comments will be accepted in accordance with Section 8.208 of Regulation #8. During the public comment period, any person may submit written comments to the Department at the above address Attention: ADEQ Air Permits Branch or to airpermits@adeq.state.ar.us by email. Any interested person may request a public hearing on the draft permitting decision during the public comment period. The public comment period shall begin on the day this notice is published and shall expire at 4:30 p.m. Central Time on the thirtieth (30th) calendar day after publication of this notice.
The Director shall make a final decision to issue or deny this application or to impose special conditions in accordance with Section 8.211 of the Arkansas Pollution Control and Ecology Commission’s Administrative Procedures (Regulation #8) and Regulation #26.
