Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Elite Comfort Solutions LLC (66-01798) operates a facility located at 4921 Sate Line Road, Fort Smith, AR 72916. Elite Comfort Solutions (Elite Comfort, AFIN 66-01798), is a newly formed company and has recently purchased the foam manufacturing and related operations from HSM Solutions (AFIN 66-00507) in Fort Smith. Elite Comfort will operate the foam manufacturing and related operations with the same equipment, in the same location, and in the same manner as it had been operated by HSM Solutions. This is an initial permit application and the facility will operate under a facility wide emission cap of 95.0 tpy of VOC, 9.5 tpy of Single HAP, and 24.5 tpy of Total HAP. All other permitted emissions are 0.6 tpy of PM10/PM, 0.2 tpy of SO2, 1.6 tpy of CO, and 7 tpy of NOx. Elite Comfort will also operate under a facility wide emission cap of 500 tpy of acetone.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.

In accordance with Ark. Code Ann. sec. 8-4-203(e), the Arkansas Department of Environmental Quality (ADEQ), Office of Water Quality, gives the following notice:
Two Rivers Harbor Property Owners Association, Inc. operates a facility located as follows: Isbell Lane, Little Rock, AR 72223 in Pulaski County. The facility is currently permitted to discharge treated domestic wastewater into the Arkansas River in Segment 3C of the Arkansas River Basin. Two Rivers Harbor Property Owners Association, Inc. submitted an application on August 3, 2016, and additional information was received on August 11, 2016, to renew NPDES Permit No. AR0050547. The application has been reviewed by the ADEQ’s Office of Water Quality and has received tentative approval subject to the terms of this notice.
The 208 Plan, developed by the ADEQ under provisions of Section 208 of the federal Clean Water Act, is a comprehensive program to work toward achieving federal water goals in Arkansas. The initial 208 Plan, adopted in 1979, provides for annual updates, but can be revised more often if necessary. Updates to the 208 Plan have been proposed to change the name of the facility from Two Rivers Harbor Subdivision to Two Rivers Harbor Property Owners Association, Inc. This change has also been incorporated into the draft discharge permit.

Enable Gas Transmission, LLC (Webb City Compressor Station) (24-00088) operates a facility located at 5627 Oak Bend Road, Ozark, AR 72949. This facility has submitted an application to renew the major source operating permit for the facility. With this renewal, the facility revises the emissions from the glycol dehydrator still vent (SN-08) to account for a change in gas composition, and also the facility is requesting a combined aggregate of 22,200 hours per year for the three (3) compressor engines (SN-01, SN-02 and SN-03). The total annual permitted emission rates will increase by 3.2 tpy VOC, 10.2 tpy CO and 12.6 tpy NOx.

Center Point Terminal Company, LLC (60-01218) operates a facility located at 3206 Gribble Street, North Little Rock, AR 72114. This facility has submitted an application to change the carbon bed adsorption/absorption vapor recovery unit (VRU) to a vapor combustion unit (VCU). Additionally, the facility is changing tank 45-3 from a fixed roof tank to an internal floating roof tank which will also be used to store gasoline. The facility’s permitted annual emissions are increasing by 0.6 tpy PM/PM10, 0.1 tpy SO2, 7.2 tpy NOx, and 8.6 tpy CO and decreasing by 1.9 tpy VOC and 0.37 tpy total HAPs.

BFI Waste Systems of Arkansas, LLC (Model Fill Landfill) (60-00565) operates a facility located at 3817 Mabelvale Pike, Little Rock, AR 72204. This facility has submitted an application to renew its Title V air permit. As of this renewal, the site is closed and not receiving any more waste. Road emissions (SN-03) are removed from the permit. This permit revision also includes a minor modification to replace the existing 3,578 scfm flare with a 1,600 scfm flare. NOTICE OF PROPOSED REGULATION CHANGES, PUBLIC HEARING, AND COMMENT PERIOD
The Arkansas Pollution Control and Ecology Commission (“APC&EC”) will hold a public hearing in North Little Rock on October 26, 2016, to receive comments on proposed revisions to APC&EC Regulation 11 (Regulations for Solid Waste Landfill Disposal Fees; Landfill Post-Closure Trust Fund; Solid Waste Management and Recycling Fund Distribution Programs). The hearing will begin at 10:00 a.m. in the Commission Room at the Arkansas Department of Environmental Quality (“ADEQ”) headquarters building, 5301 Northshore Drive, North Little Rock, AR 72118. The deadline for submitting written comments on the regulation is 4:30 p.m. (Central Time) November 9, 2016.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearing. If the hearing is postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period.

Central Arkansas Water - Jack H. Wilson Water Treatment Plant operates a facility located as follows: 338 Pleasant Valley, Little Rock, AR 72212 in Pulaski County. The facility is currently permitted/proposes to discharge drain or overflow from clearwells, pump station, contact chamber, settling basins, waste water tank, filter backwash, rapid mixers, and lab sink into an unnamed tributary, thence to Grassy Flat Creek, thence to Rock Creek, thence to Fourche Creek, thence to the Arkansas River in Segment 3C of the Arkansas River Basin. Central Arkansas Water - Jack H. Wilson Water Treatment Plant submitted an application on June 1, 2016, with additional information received June 15, 2016, for renewal of NPDES Permit No. AR0047937. The application has been reviewed by the ADEQ’s Office of Water Quality and has received tentative approval subject to the terms of this notice.

Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Lion Oil Company (70-00016) operates a facility located at 1000 McHenry Drive, El Dorado, AR 71730. This permit is a minor modification to incorporate modifications to the Gasoline/Diesel Loading Rack, SN-846. There was no increase in permitted emission rates.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.

NOTICE OF PROPOSED REGULATION CHANGES, PUBLIC HEARING, AND COMMENT PERIOD
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold a public hearing in North Little Rock October 21, 2016, to receive comments on proposed revisions to APC&EC Regulation 9 (Fee Regulation). The hearing will begin at 2:00 p.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, AR 72118. The deadline for submitting written comments on the regulation is 4:30 p.m. (Central Time) November 4, 2016.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearing. If the hearing is postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period. APC&EC authority for revising Regulation 9 is found in the Arkansas Code Annotated, Sections 8-1-103, 8-4-201, and 8-4-202.
Proposed revisions to Regulation 9 include amendments to the definitions to add “Q” or “Quantity” for clarification because the term is used in Chapter 4 concerning the calculation of water permit fees; Chapter 4 formulas for clarification to make the regulation easier to understand; incorporate a proposed fee calculation for minor municipal and non-municipal facilities with the National Pollutant Discharge Elimination System (NPDES) permits under Reg. 9.403 for limits of toxic pollutants based solely on Total Maximum Daily Load (TDML) to allow ADEQ to assess lower water permit fees for qualifying facilities; update the fee schedule in Chapter 4 to reflect permits currently offered by the Office of Water Quality and eliminate four General Permits under Reg.9.404 that are no longer issued by the Office of Water Quality; incorporate statutory changes made by the General Assembly concerning contribution fees to the Nonmunicipal Domestic Sewage Treatment Works Trust Fund; make minor, non-substantive stylistic and formatting corrections throughout the Regulation.
