GENERAL PERMIT NOTICES OF INTENT
Public notice is hereby given that the Arkansas Department of Environmental Quality (ADEQ) has determined that the Notices of Intent (NOIs) seeking coverage under an Air Division General Permit submitted for the facilities listed below are administratively complete. Technical reviews of the NOIs are being conducted to determine if the source meets the qualification for coverage under the applicable General Permit. Documents for these matters are available for inspection or copying by contacting ADEQ's Air Division Permits Branch, 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317. There may be a photocopying charge for some documents.
Interested persons may submit a written request for a public hearing for any of the Notices of Intent listed below. Such request must be submitted in writing to the Department at the above-noted address with Attention directed to the ADEQ Air Permits Branch or to airpermits@adeq.state.ar.us by email. Request for public hearing must state the reasons for the necessity of a public hearing and be postmarked or submitted electronically to the Air Division Permits Branch within ten (10) business days of this notice. This notice shall expire at 4:30 p.m. Central Time on the tenth (10th) business day after publication of this notice. The Department has the discretion to determine whether a hearing is deemed necessary if a request is made.

This is to give notice in accordance with A.C.A. sec. 8-4-203(m)(5)(A)(i), the Permits Branch of the Office of Water Quality of the Arkansas Department of Environmental Quality (ADEQ), 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317 at telephone number (501) 682-0623, has made a decision to renew the above General Permit, which is set to expire on February 28, 2017, under the National Pollutant Discharge Elimination System and the Arkansas Water and Air Pollution Control Act. This permit authorizes the discharge of biological pesticides or chemical pesticides (including insecticides, nematicides, rodenticides, fungicides, and herbicides) that leave a residue in water when such applications are made into or over, including near, Waters of the State.

Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
The Department is proposing to renew the minor source general air permit for qualifying hot mix asphalt facilities (1912-AGP-000) located within the borders of the state of Arkansas. This is the third renewal of the permit. This permit renewal changes include requirements for compression ignition stationary engine, gasoline storage tank, and facility wide emission limits. The permit removes the requirement to test for NOX, CO and VOC. This permit will also be applicable to facilities where multiple asphalt production units are located at a common site. Facilities wishing to operate under this permit must comply with all conditions and requirements set forth herein. This permit shall be issued for the asphalt mixing, aggregate feed, asphalt heater, aggregate storage piles, RAP processing, shingle grinding, diesel/fuel storage, and stationary compression ignition engines at the facility. Facilities which operate processes other than that described in this permit may not qualify for this general permit and may be required to obtain a standard Minor Source or Title V air permit from the Department.

Citizens desiring technical information concerning the application or permit should contact, Jesse Smith, Engineer. Both ADEQ Air Permits Branch and Jesse Smith can be reached at the Department’s central office, 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317, telephone: (501) 682-0730.
The draft permit and permit application are available for copying at the above address. This information may be reviewed during normal business hours. The draft permit may also be found at http://www.adeq.state.ar.us/air/permits/draft_noi.aspx.
Comments will be accepted in accordance with Section 8.208 of Regulation #8. During the public comment period, any person may submit written comments to the Department at the above address Attention: ADEQ Air Permits Branch or to airpermits@adeq.state.ar.us by email. Any interested person may request a public hearing on the draft permitting decision during the public comment period. The public comment period shall begin on the day this notice is published and shall expire at 4:30 p.m. Central Time on the thirtieth (30th) calendar day after publication of this notice.
The Director shall make a final decision to issue or deny this application or to impose special conditions in accordance with Section 8.211 of the Arkansas Pollution Control and Ecology Commission’s Administrative Procedures (Regulation #8) and Regulation #26.
