Facility: Former DM Petroleum Bulk Plant I.D. #: 05001518, AFIN# 05-00165 Leaking Aboveground Storage Tank Case #: 05-0015 Facility Location: 2523 Highway 43 East, Harrison, Arkansas
Notice is given in accordance with the provisions of Title 40 of the Code of Federal Regulations, Section 280.67(d) that implementation of a Remedial Action Plan (RAP) has been completed and termination of the RAP is under consideration by the Arkansas Department of Environmental Quality (ADEQ).
A Remedial Action Plan was approved by ADEQ on November 14, 2007, in response to a release of petroleum contamination at the former DM Petroleum Bulk Plant, 2523 Highway 43 East, Harrison, Boone County, Arkansas. Following public notice in accordance with the provisions of 40 CFR 280.67(a) and (b), the Remedial Action Plan was implemented and an initial report submitted to ADEQ on September 19, 2008. Based on monitoring data submitted since 2008, ADEQ has concluded that attainment of the plan goals has been substantially met and that the LAST case should be closed without further corrective action.

In response to written requests, ADEQ will hold a public hearing whenever the ADEQ Director determines such a hearing might clarify issues concerning implementation of the Remedial Action Plan and the tentative decision. Any request for a hearing must include the requestor’s name and address and shall state the nature of the issues to be raised in a hearing. ADEQ will issue a public notice of a hearing at least 30 days prior to the scheduled hearing.
Submitting written comments to ADEQ or making oral statements on the record at a public hearing, if one is held, on the proposed action provides individuals with legal standing to appeal a final Department decision. Comments supporting or opposing the tentative decision will provide legal standing. Only parties with legal standing may appeal a decision.

Central Arkansas Water - Ozark Point Water Treatment Plant operates a facility located as follows: North Martin & Hill Road, Little Rock, AR 72205 in Pulaski County. The facility is currently permitted to discharge filter backwash, clearwell #3 drain into an unnamed tributary, thence to the Arkansas River in Segment 3C of the Arkansas River Basin. Central Arkansas Water - Ozark Point Water Treatment Plant submitted an application on June 1, 2016, with additional information received June 15, 2016, for renewal of NPDES Permit No. AR0047929. The application has been reviewed by the ADEQ’s Office of Water Quality and has received tentative approval subject to the terms of this notice.

C12: Arkansas, LLC - Tract 12 Production Facility & Office/SWD Facility (37-00286) operates a facility located at approx. 4.3 miles SW of Mt. Pleasant, Sec. 11, T15S-R24W, Stamps, AR 71860. This facility has submitted an application to incorporate the following:
• Installation of a field gas-fired engine to drive a saltwater disposal pump (SN-19-16-ICE-ES),
• Installation of an additional 210 bbl oil storage tank (SN-20-16-OST-CV),
• Removal of three existing spark ignition engines from the facility (SN-2-07-ICE-ES, SN-3-07-ICE-ES, SN-16-10-ICE-ES),
• Removal of several “out of service” and “backup” tanks (5d-07-OST-CV, 5e-07-OST-CV, 5f-07-OST-CV),
• Increase the maximum throughput of water to 137,970,000 gallons (3,285,000 barrels) of produced water per consecutive 12-month period (SN-17-10-WST-V),
• Increase the allowable annual throughput of produced oil to 4,000 bbl/year for SN-18-15-OST-V,
• Reduction of the total maximum daily throughput for the facility to 85 bb/day of crude oil, and
• Consolidation of the HAP emissions for sources emitting such into a single “Total HAP” category per source.
The changes result in the following emission increases: 2.0 tpy of VOC and 11.6 tpy of NOx. Additionally, the changes will result in an emission decrease of 0.1 tpy of SO2, 7.6 tpy of CO and 1.12 tpy of Total HAP.

Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
The Department is proposing a new Title V general air permit for qualifying air curtain incinerators (2370-AGP-000) located within the borders of the state of Arkansas. This is the initial version of the permit. The general permit allows installation and operation of municipal, commercial, industrial, or institutional air curtain incinerators which may only burn wood waste, clean lumber, and yard waste. The permit accounts for emissions from the waste burned in the incineration unit as well as the engine to operate it. The maximum emissions from these sources are 242.5 tons per year (tpy) PM/PM10, 3.6 tpy SO2, 61.8 tpy VOC, 67.7 tpy CO, 106.2 tpy NOX and 7.12 tpy Total HAPs.

Clean Harbors El Dorado, LLC (70-00098) operates a facility located at 309 American Circle, El Dorado, AR 71730. This facility has submitted an application to add fuel storage tank for SN-44 start up (SN-45), a gondola transferring operation (SN-46), and a solidification silo bin vent (SN-47). The process description was also updated to specify medical waste incineration, as the facility is considered an existing medical waste incineration facility. As a result of this modification, permitted PM emissions increased by 11.4 tpy, PM10 emissions increased by 6.3 tpy, and permitted VOC emissions increased by 0.1 tpy.

LM Wind Power Blades (Arkansas), Inc. (60-04199) operates a facility located at 8000 Frazier Pike, Little Rock, AR 72206. This facility has submitted an application to add blade repair operations outside the production building (SN-P04A and SN-P04B), shut down the Scott Hamilton facility (AFIN 60-04196), and add insignificant activities (laboratory vent, portable generators, and portable air compressors) to the Port facility. The permitted emission decreases include 6.6 tpy of PM/PM10, 0.5 tpy of SO2, 102.3 tpy of VOC, 11.4 tpy of CO, 14.4 tpy of NOx, 102.28 tpy of HAPs, and 50 tpy of Acetone.

NOTICE OF EMERGENCY
ORDER
Pursuant to Arkansas Code Annotated sections 8-4-101 et seq., 8-1-202 (b)(2)(c), and 8-4-220, the Arkansas Department of Environmental Quality (ADEQ) has issued an emergency order in connection with an unpermitted discharge of raw sewage from a wastewater treatment facility in Turrell in Crittenden County. The facility is operated by the City of Turrell and is located east of town at Big Creek and Burlington Railroad, Turrell, Crittenden County, Arkansas 72384.
The unpermitted discharge threatens the Little Cypress Bayou, Big Creek, Tyronza River, and St. Francis River.
An ADEQ inspector discovered the unpermitted discharge during an inspection of the facility on August 29, 2016. The inspection revealed the influent force main had collapsed, causing untreated sewage to discharge from the facility’s influent force main directly into Little Cypress Bayou. The break in the influent force main occurred where it crosses Little Cypress Bayou.
On the following day, August 30, 2016, ADEQ personnel collected samples at the site of the discharge. Subsequent analysis of the samples found excessive levels of fecal coliform bacteria and E. coli bacteria, which pose threats to human health and the environment.
The emergency order directs the city to immediately cease the unpermitted discharge, conduct a cleanup of the area impacted by the unpermitted discharge, and provide evidence that it has complied with the emergency order.
Nothing in the order prevents the ADEQ from seeking to recover its costs in connection with the incident or taking appropriate enforcement action against any party determined to be responsible for the unpermitted discharge.

REGULATION CHANGE, PUBLIC HEARINGS
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold a public hearing in North Little Rock on September 30, 2016, to receive comments on proposed revisions to APC&EC Regulation 6 (Regulations for State Administration of the National Pollutant Discharge Elimination System (NPDES)). The North Little Rock hearing will begin at 2:00 p.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, AR 72118.
APC&EC will hold a second public hearing in Springdale on October 4, 2016, to receive comments on proposed revisions to APC&EC Regulation 6. The Springdale hearing will begin at 6:00 p.m. in the Jones Center for Families, 922 E. Emma Ave., Springdale, AR 72764.
The deadline for submitting written comments on the regulation is 4:30 p.m. (Central Time) October 19, 2016.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearing. If the hearing is postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period.

Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
West Fraser, Inc. (27-00002) owns and operates the Leola Lumber Mill at 1400 Main Street, Leola, AR 72084. With this permit revision, the provisions of 40 CFR Part 63, Subpart DDDDD (Boiler MACT) are being incorporated into the permit for subject sources SN-01A and SN-01B (No.1 and No. 2 Wood Fired boilers). Both boilers are considered existing boilers under the rule. The No. 3 Boiler (SN-19) is no longer operated at the facility and thus this boiler has been removed from the permit. In addition to the above mentioned modification, West Fraser has requested that the testing requirement for the Planer Mill Baghouse be removed from the permit. Given the supporting information submitted by the applicant the testing has been removed from the draft permit. The above referenced revisions to the permit will result plant wide annual permitted emission limit decreases of 23.6 tons of PM/PM10/PM2.5, 1.1 tons of SO2, 1.5 tons of VOC, 48.5 tons of CO, 19.3 tons of NOx, 0.03 ton of Acetone, and 0.53 ton of combined HAPs.

Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality (ADEQ) gives the following notice:
ADEQ announces its intent to reissue the Minor Source General Air Permit for Rock Crushing Facilities (1916-AGP-000). The general permit is for air emissions from rock crushing facilities located in the State of Arkansas. ADEQ will propose a draft permit and issue a final permit at least six months before the expiration date of September 13, 2017.

Pursuant to A.C.A. sec.8-4-203, and the regulations promulgated thereunder, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
Anchor Packaging, Inc. - Jonesboro Plant (16-00181) operates a facility located at 4708 Krueger Drive, Jonesboro, AR 72401. This facility has submitted an application for a minor source permit, due to anticipated growth and expansion projects, to operate twelve (12) inline thermoforming machines. The proposed emissions are 8 tons per year (tpy) of PM/PM10, 45.1 tpy VOC, 88 tpy VOC, and 9.7 tpy NOX.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.
