Public notice is hereby given that the Arkansas Department of Environmental Quality (ADEQ) has determined that the Notices of Intent (NOIs) seeking coverage under an Air Division General Permit submitted for the facilities listed below are administratively complete. Technical reviews of the NOIs are being conducted to determine if the source meets the qualification for coverage under the applicable General Permit. Pursuant to the Arkansas Operating Air Permit Program (Regulation #26) Section 602, the Air Division of the Arkansas Department of Environmental Quality gives the following notice:
FutureFuel Chemical Company (32-00036) operates a facility located at 2800 Gap Road, Batesville, AR 72501. This facility has submitted an application to remove TF-2, TFV-1, and TFV-3 from the 5N03-TK01 emission bubble, remove TF-6, TF-7, TF-10, and TF-11 from the Insignificant Activities List, correct TFB-2 to TFB-22 in the 5N03-TK01 emission bubble, add T-273, TFS-6, and TF-8 to the 5N03-TK01 emission bubble, and move TF-5FS from the Insignificant Activities List to the 5N03-TK01 emission bubble. There are no permitted changes in emissions with these actions.
The application has been reviewed by the staff of the Department and has received the Department’s tentative approval subject to the terms of this notice.

Notice is hereby given under Ark. Code Ann. sec. 8-4-230(e)(1) that the Director of the Arkansas Department of Environmental Quality (ADEQ), 5301 Northshore Drive, North Little Rock, AR 72118-5317, phone number 501-682-0618, has granted a temporary variance from Permit No. 2335-A for Trinity Rail Maintenance Services to begin cleaning, mechanical repair, refurbishment and retrofitting of railroad tank cars and parts to conform with new U.S. Department of Transportation standards for railroad tank cars. The activities will take place at the company’s facility located at 3100 Nordex Dr., Jonesboro, AR 72401. The temporary variance is limited to a period of ninety (90) days and up to 53 railcars containing fuel oil or naptha each.
This decision is subject to and contingent upon the right of the public to object to the Director’s decision. Any member of the public may object to the Director’s decision or request a public hearing within ten (10) business days of the date of this notice. Objections or requests for a public hearing will be accepted if submitted no later than 4:30 p.m. Central Time on the last day of the comment period. In accordance with provisions of Arkansas Statutes, 8-4-203, public notice is hereby given that as of May 24, 2016, the Mining Program and Administration, Office of Land Resources of the Arkansas Department of Environmental Quality (ADEQ) announces its draft decision to issue a new open-cut mining permit as requested by Easterling Wood Products, Inc., P.O. Box 459 Huntsville, AR 72740 for a mining facility located near the city of Huntsville in Madison County, Arkansas.
The gravel mining facility, "Wharton Creek Site" is located in Section 19, Township 16N, Range 25W adjacent to Wharton Creek. The mining facility will affect less than two acres with an estimated annual production of 1,000 tons of gravel per year.
Any interested person may submit written comments concerning the technical merits of the ADEQ's draft decision within 30 days of the publication of this notice. EMERGENCY ORDER OF THE DIRECTOR
The Director of the Arkansas Department of Environmental Quality (“ADEQ or “Department”) has determined that emergency conditions exist due to a substance that has been abandoned.
The release or threatened release of the potentially hazardous abandoned substance(s) presents an imminent and substantial endangerment to the public health, safety or welfare or to the environment.
Therefore, pursuant to authority provided by the Remedial Action Trust Fund Act as set forth in Ark. Code Ann. sec. 8-7-501 et seq.; the Arkansas Hazardous Waste Management Act as set forth in Ark. Code Ann. sec. 8-7-201 et seq.; the Arkansas Solid Waste Management Act as set forth in Ark. Code Ann. sec. 8-6-201 et seq.; the Arkansas Water and Air Pollution Control Act as set forth in Ark. Code Ann. sec. 8-4-101 et seq. and the regulations promulgated thereunder; the Director makes the following Findings of Fact and orders the following remedial actions to be taken immediately to remedy the emergency conditions.
FINDINGS of FACT
1. Fort Smith Petro Environmental, LLC is a used oil processor, located at 11802 Roberts Blvd., Fort Smith, Sebastian County, Arkansas. The facility consists of nine (9) vertical tanks and one (1) open-top tank.
2. On June 3, 2016, the ADEQ Fort Smith field office received a complaint that a release had occurred at 11802 Roberts Blvd, Fort Smith, Sebastian County, Arkansas. The complaint was investigated Monday, June 6, 2016 confirming the release. The National Response Center in Washington, D.C., was contacted to report the release generating report # 1149861.
3. Photographs of the site indicate an oil like substance flowing across the ground to a ditch and into a tributary of Little Vache Grasse Creek. The photographs also show the secondary containment for the tanks are at maximum capacity. Fort Smith Fire Department HazMat responded and installed containment berm in the ditch in an attempt to keep additional waste material out of the creek. The open-top tank was overflowing into the secondary containment which had overflowed onto the ground. Their inspection of the site revealed seven (7) of the nine (9) tanks were open at the top. HazMat closed the hatches on top of the tanks. An unknown amount of the oil like substance has migrated across the ground and off site with the potential for additional releases from the secondary containment, causing further environmental impact and damage.
4. Fort Smith Petro Environmental, LLC is registered with the Arkansas Secretary of State’s office and is in good standing. The company contact is Ashish Sanon of Florida. After several unsuccessful attempts to contact Mr. Sanon, the Registered Agent for the company, Ronald D. Harrison, was contacted. Mr. Harrison was able to reach Mr. Sanon on June 6, 2016, who agreed to retain a contractor and begin addressing the release. The contractor was to begin work the morning of June 7, 2016.
5. There have been no operations at the facility since December 2015. The facility appears to be abandoned.
6. ADEQ responded to the site June 7, 2016 to observe the response actions. The initial contractor was waiting on a signed agreement prior to starting work. The initial contractor departed the site the afternoon of June 7, 2016 due to no agreement with Mr. Sanon. Another contractor was contacted to respond and arrived on site the afternoon of June 7, 2016. On the afternoon of June 7, 2016 and June 8, 2016, the contractor removed fluids from the secondary containment for the open-top tank and transferred them to a frac tank. The contractor informed ADEQ June 8, 2016 that they did not have a contract with Mr. Sanon and were stopping work on the site. As of the afternoon of June 8, 2016, no action is being taken to remove the remainder of fluids or remediate the impacted soil and creek due to the inability of Mr. Sanon to retain contractors.
7. Mr. Sanon was contacted on June 8, 2016 to determine if another contractor would be secured to conduct the remedial actions. Mr. Sanon indicated he could not secure another contractor and would rather ADEQ issue an Emergency Order.
Based on the facts and nature of this situation, the Director has determined that an emergency exists and issues a verbal order, as allowed by Ark. Code Ann. sec. 8-7-508(k), of remedial action in accordance with Ark. Code Ann. sec. 8-1-202(b)(2)(C), sec. 8-4-220, sec. 8-4-304, sec. 8-6-202, sec.8-7-213, sec. 8-7-214 and sec. 8-7-508(h).
ORDER of REMEDIAL ACTION
The Director, on June 8, 2016, orders the following actions be taken:
1. Fort Smith Petro Environmental, LLC shall, upon issuance of this Order:
a. Secure the facility to prevent unauthorized entry to the site;
b. Retain a qualified response contractor capable of properly removing all released waste materials, transporting, securely storing, characterizing, identifying, and properly disposing of the waste material; and,
c. Provide all necessary documentation as may be requested by ADEQ to include at a minimum: a report of activities conducted, photographs, waste characterization analyses, waste manifests and receipts issued by the facility receiving the waste material for final disposal.
2. In the event Fort Smith Petro Environmental, LLC does not comply with this Order, the Director shall direct the Emergency Response Section to secure the services of a qualified response contractor capable of properly removing and disposing of the waste material associated with site remediation in accordance with paragraph one (1) above. Any contractor secured by ADEQ shall provide detailed billing to ADEQ.
3. Should the Responsible Party elect to conduct or contract from another source and not assume responsibility for the work performed by the ADEQ secured Contractor, ADEQ will assume financial responsibility of incurred expenses of said Contractor and will seek financial relief and penalties from the Responsible Party not to exceed three times the actual costs incurred by ADEQ plus any associated penalties, as may be allowed by law.
To prevent endangerment to public health, safety or welfare or to the environment, ADEQ shall have use of moneys from the Remedial Action Trust Fund Act to take necessary actions to include hiring and paying for personnel and equipment to properly abate the endangerments with such costs being billed to the responsible party, if identified, along with applicable charges as allowed by law, in accordance with Ark. Code Ann. sec.8-7-514.
Nothing in this Order shall limit the rights of ADEQ to issue further orders to pursue any further enforcement actions for remediation, penalties and/or costs from any party.
This Order is effective immediately upon verbal issuance and is confirmed by signature of the Director.

American Railcar Industries, Inc. - Paragould (28-00251) operates a facility located at 901 Jones Road, Paragould, AR 72450. This facility has submitted an application to renew the Title V permit. In this renewal, a CAM Plan has been submitted for the dust collectors, all natural gas sources have been grouped under SN-09 (previously SN-09 and SN-17), and trace HAPs have been identified and permitted for the dust collectors and natural gas sources. A minor mod is also included in this permitting action. In this minor mod, the welding operations (previously SN-10 and SN-11) were reclassified as insignificant activities and a new aluminum melt furnace area was added to the SN-09 natural gas combustion sources.
As a result of this revision, PM/PM10 emissions decreased by 0.1 tpy, SO2 emissions decreased by 0.5 tpy, VOC emissions increased by 0.6 tpy, CO emissions increased by 12 tpy, NOX emissions increased by 16.2 tpy, and Total HAP emissions increased by 1.1 tpy.

This permit is for the operation of a decentralized waste water treatment system with drip irrigation dispersal for a residential subdivision. This type of systems is also classified as Class V shallow injection wells under the provisions of APC&EC Regulation No. 17.Location: The wastwater facility is located in Benton County at 2199 Price Avenue Lowell, AR 72745; Latitude: 36°15’24” N Longitude: 94°11’8” W.
The facility is located in Stream Segment 3J of the Arkansas River Basin.

Public notice is hereby given that the Arkansas Department of Environmental Quality (ADEQ) has entered into the Consent Administrative Orders and has issued the Notices of Violation listed below. Documents for these enforcement matters can be made available for inspection or copying by contacting ADEQ's Legal Division, 5301 Northshore Drive, North Little Rock, Arkansas 72118-5317. There may be a charge to cover photocopying costs for some documents. Copies of enforcement documents, including those referenced in this notice, also are available for viewing on the ADEQ website at http://www.adeq.state.ar.us/legal/cao_info.asp. Further, ADEQ is accepting written comments from the public regarding these matters. Such comments must be sent to ADEQ, Legal Division, at the above address within 30 days after publication of this Notice.
