NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on April 21, 2015, a public hearing, as required by Section 147(f) of the Internal Revenue Code of 1986, will be held by the City Council of the City of Fayetteville, Arkansas with respect to the proposed issuance by the Public Finance Authority (the “Authority”) of its revenue bonds in one or more series and in the aggregate principal amount not to exceed $50,000,000 (the “Bonds”).
The Bonds are expected to be issued pursuant to Section 66.0304 of the Wisconsin Statutes, as amended, and the proceeds from the sale of the Bonds will be loaned to limited liability companies (each a “Borrower” and collectively, the “Borrowers”) whose single member will in each case be a corporate affiliate of American Agape Foundation, Inc., a Texas nonprofit corporation and an organization described in Section 501(c)(3) of Code. The proceeds of the Bonds will be used by the Borrower for the purpose of financing or refinancing the costs to: (a) acquire, renovate, furnish and equip the following residential rental housing communities: (i) Canaan Towers located at 400 North Dale Avenue, Shreveport, LA 71101, (ii) Park Lake located at 1753 E. Zion Road, Fayetteville, AR 72703, which contains 91 units, (iii) Himbola located at 804 Martin Luther King Drive, Lafayette, LA 70501 and (iv) Oakwood Terrace located at 700 West Truman Avenue, Pensacola, FL 32505 (each a “Project” and collectively, the “Projects”), (b) to pay capitalized interest on the Bonds, (c) to fund reserves, and (d) pay certain costs associated with the issuance of the Bonds. Each Project will be owned and operated by the respective Borrower.
The Bonds will be limited obligations of the Authority payable solely from the loan repayments to be made by the Borrowers to the Authority, and certain funds and accounts established by the bond indenture for the Bonds. In no event shall the City of Fayetteville be liable for such bonds nor shall the bonds constitute a debt of the City of Fayetteville.
The hearing will commence at 5:30 p.m. or as soon thereafter as the matter can be heard and will be held in Room 219 at City Hall, 113 West Mountain Street, Fayetteville, Arkansas 72701. Interested persons wishing to express their views on the issuance of the Bonds or on the nature or location of the Projects proposed to be financed may attend the public hearing or, prior to the time of the hearing, submit written comments to the Fayetteville City Clerk, 113 West Mountain Street, Fayetteville, Arkansas 72701 or by email to cityclerk@fayetteville-ar.gov.
