NOTICE OF RULE MAKING
The Director of the Division of Medical Services hereby issues the following proposed medical assistance rule(s) under one or more of the following chapters or sections of the Arkansas Code: 20-10-211(a), 20 10-203(b), 20-76-433, 25-10-129, and Title 20, Chapter 77.
Effective October 1, 2016, revisions will be made to the Group Psychotherapy code 90853 reducing the maximum number of units that may be billed daily from 6 to 4 and limiting the yearly maximum number of units that may be billed without an extension of benefits to 100. These changes were proposed after a study was performed which showed that the current rate structure, benefit limit, and total reimbursement for procedure code 90853 in Arkansas deviates significantly from surrounding states and Medicare. The current limits for the code allow for overutilization and improper use of group psychotherapy services in Arkansas. The overutilization and improper use of the code significantly impacts quality of care and Medicaid spending. The change should result in significant savings to the Arkansas Medicaid program as well as prevent fraud, waste and abuse. The estimated annualized savings for FFY 2018 is $36,104,000.

The purpose of the proposed amendments is to comply and implement the provisions of Act 848 of 2015 (dealing with the licensure of military personnel and their spouses); Act 1066 of 2015, (dealing with reinstatement of licenses); Act 95 of 2015 (permitting for good cause a 6-month extension on boiler inspections); and Act 1258 of 2015 (dealing with rule-making). NOTICE OF PROPOSED REGULATION CHANGES, PUBLIC HEARING, AND COMMENT PERIOD
The Arkansas Pollution Control and Ecology Commission (APC&EC) will hold a public hearing in North Little Rock September 30, 2016, to receive comments on proposed revisions to APC&EC Regulation 11 (Regulations for Solid Waste Disposal Fees; Landfill Post-Closure Trust Fund; Solid Waste Management and Recycling Fund Distribution; and Recycling Grant Programs). The hearing will begin at 10:00 a.m. in the Commission Room at the Arkansas Department of Environmental Quality (ADEQ) headquarters building, 5301 Northshore Drive, North Little Rock, AR 72118. The deadline for submitting written comments on the regulation is 4:30 p.m. (Central Time) October 14, 2016.
In the event of inclement weather or other unforeseen circumstances, a decision may be made to postpone the hearing. If the hearing is postponed and rescheduled, a new legal notice will be published to announce the details of the new hearing date and comment period. APC&EC authority for revising Regulation 11 is found in the Arkansas Code, Annotated, Sections 8-6-207(b)(1), 8-6-602(d), 8-6-610, and 8-6-613(c).
Proposed revisions to Regulation 11 include amendments to Reg.11.205 to incorporate existing statutory law concerning “(C) Fee Schedule for Computer & Electronic Waste Fund Distribution Program” that becomes effective when the Landfill Post-Closure Trust Fund balance equals or is less than fifteen million dollars ($15,000,000) as provided in Ark. Code Ann. sec. 8-6-1002(a)(3)(B); Chapter 3 concerning the Landfill Post-Closure Trust Fund Program to incorporate statutory changes made by the General Assembly to allow Landfill Post-Closure Trust Fund monies to be used to close waste tire processing or disposal sites that are owned and operated by a regional solid waste management district under limited circumstances and to strike all provisions that have been rendered obsolete by the statutory changes; other Chapters of the Regulation for consistency with the statutory changes made by the General Assembly and primarily concerning terminology and program name changes; and minor, non-substantive stylistic and formatting corrections throughout the Regulation.
