Lawyer told to retrieve all copies of e-mails

— The Houston Nutt-Mitch Mustain flap hasn't gone away yet.

In the latest turn of events, Fort Smith attorney Eddie Christian Jr., has been ordered to retrieve e-mails he obtained and then sent to others in connection with a lawsuit filed in 2007 against John White, who at the time was the University of Arkansas chancellor.

Christian represented John David Terry, an Arkansas graduate who sued White for failing to properly investigate critical e-mails sent during the 2006 season to Mustain - a former Springdale High School and UA quarterback now at Southern California - by Teresa Prewitt, a family friend of Houston Nutt, the former Razorbacks' coach who is now at Ole Miss.

Terry's case against White twice has been thrown out and lost an appeal to the Arkansas Supreme Court.

In 2007, Washington County Circuit Judge Mark Lindsay ordered Christian to cease discovery, which is an effortto obtain evidence and testimony in a lawsuit, because an appeal was pending.

But Christian issued a subpoena to the Arkansas Department of Finance and Administration for e-mails regarding the UA football program sent by Sherri Darby, a housemate of Prewitt's, and the state agency sent him the e-mails.

Christian forwarded the e-mails to media members and others, defying Lindsay's court order.

Christian then was cited for contempt by Lindsay and fined $21,000.

Lindsay has now ordered Christian to retrieve any copies of the Darby e-mails he forwarded and return them to the Department of Finance and Administration. Those who fail to return the copies face the possibility of being held in contempt.

Mustain left Arkansas after the 2006 season and transferred to USC, where he will be a redshirt junior this season.
