New trial date set for Barrett

Scheduled to begin this week, proceedings have been pushed back to Oct. 12.

— Jury selection is now set to begin at 1:30 p.m. Oct. 12 in Roger Dale Barrett's capital-murder case.

Prosecutors are not seeking the death penalty for Barrett, so if found guilty of the capital-murder charge, he will be sentenced to life in prison.

Barrett, 50, is accused of killing Eunice Belinda "Yogi" Bradley during an Aug. 21, 2000, altercation at his Cave Springs home.

Bradley was shot in the chest and died from the gunshot wound. Her body was later found burning in a brush fire near Highfill.

Investigators arrested Barrett a few days after the discovery of the body.

The trial was originally scheduled to begin Monday, but Circuit Judge David Clinger granted a motion to continue the case after divers found the gun that prosecutors believe was used to kill Bradley. Divers found the gun Aug. 8 in a pond on Hendrix Road.

Barrett's attorney claims the shooting was in selfdefense.

In July 2001, a jury found Barrett guilty of capital murder, and he was sentenced to life in prison.

In Oct. 2006, then Circuit Judge Tom Keith granted Barrett a new trial. Keith found that Barrett's former attorney, John Gross, did such a poor job defending Barrett that it prevented him from receiving a fair trial.

Almost a year later, the Arkansas Supreme Court upheld Keith's decision and granted Barrett a new trial.

Several weeks later, Barrett was returned to Benton County and released from custody on $150,000 bond.

A pretrial hearing in the case is scheduled for 1:30 p.m. Sept. 8.
