6 judges reject PSC approval of power plant

Appeals panel says consent given in stages counter to law

The $2.1 billion coal-fired John W. Turk Jr. power plant project under construction near Texarkana saw a major setback Wednesday as the Arkansas Court of Appeals unanimously rejected its approval by state utility regulators.

The Hempstead County site was chosen to meet the needs of Louisianna and Texas residents not Arkansas residents. It is downwind of those customers but upwind of most Arkansas residents.

The Hallsville, Texas site would have been cheaper if the power line cost were considered. They knew they could not roll over Texans.
