McDonald's to sue 3rd party in naked photo lawsuit

— A Washington County judge is giving McDonald's Corp. permission to sue a third party in a lawsuit over nude pictures of an Arkansas woman that wound up on the Internet.

Phillip and Tina Sherman are suing McDonald's and the owner and the manager of a Fayetteville store for $3 million. The Sherman's say they left Phillip Sherman's cell phone at the store and an employee who found it later posted on the Internet nude photos of Tina Sherman that she had sent to her husband's phone.

Washington County Circuit Judge Mary Ann Gunn granted McDonald's motion to sue Cody Hess, who is accused of being the cause of any damages the Shermans may have suffered.
