The Arkansas Supreme Court has denied an appeal by Anne Throneberry over her 2007 conviction and sentencing in the death of her husband.

Justices ruled Thursday that a lower court judge didn’t have to reveal what information he used to impose a tougher sentence than what her jury recommended. The state Court of Appeals overturned her 28-year sentence in 2008 and order her to be resentenced.

Authorities say Throneberry helped co-defendants William James Frazier and Mark Holsombach kill her husband, Ted Throneberry, then escape after a March 22, 2004, shootout with an Arkansas State Police trooper. The trooper was wounded in the shootout and the suspects were on the run for two weeks before being captured.

Anne Throneberry testified at trial that she was kidnapped and held hostage after her husband was murdered.
