Curtis Lavelle Vance’s poor performance in school, failure to earn a high-school diploma, inability to hold a job, lack of a driver’s license and failure to live independently are indications he is mentally retarded, when taken into consideration with his IQ , a defense psychologist has reported in court filings.

Vance, 29, of Marianna, accused of capital murder in the death of Little Rock TV news anchor Anne Pressly, makes his ninth Pulaski County Circuit Court appearance at 9:30 a.m. today before Judge Chris Piazza. His attorneys are attempting to persuade the judge to give them more time to establish that Vance has mild mental retardation - a finding that would force prosecutors to drop their efforts to ...

Retarded or not, it shouldn't matter. The person who commited this crime deserves no mercy, pitty, excuses, etc. This person could have simply robbed Presley. Instead, they opted to brutally rape & beat her as well. I don't car what the mental condition of a person is. If they kill or rape a person, no amount of retardation should get them off. They are a menace to society & should be delt with as such. It seems we've forgetten who the real victims are in this country. I believe we need to go back to public hangings & fireing squads for sicko's like this & it needs to take place imeadiatly after the trial & not make the tax payers babysit these scumbags for tweenty years while they get a college degree in prision. Come on people, this countries judicial system has more policies about why people can't be held accountable for their actions than they have around protecting the law abiding citizens. Something needs to change!

How far we have fallen as a people when we do not hold people accountable for their actions.

How did Vance get to Pressly's home? How did he get in? He apparently knew what he wanted, as he got it and more, then he murdered Pressly. If he was "competent" enough to do all of this, then how in the world could he not be competent to stand trail and receive the penalty for his actions?

If a vicious dog attacks someone and kills them, the dog is put down. Not many humans can claim to be less mentally capable than a dog. Yet for some reason we treat people differently.

Further, all of the "symptoms" listed could be just as relevant to someone who just doesn't care about anyone or anything -

But lets just assume for a moment that Vance is mentally retarded/low IQ... does that make him any less of a murderer? Does it make Pressly any less dead? Does it make the crime any less ugly?

The fact of the matter is - the defense knows that the prosecution has a slam-dunk case, and that Vance will probably face the death penalty. They are desperate. I am sure Pressly was pretty desperate as Vance was bashing her brains in...
