LITTLE ROCK A man sentenced to three years in federal prison has lost an appeal in which he argued his statement to police shouldn’t have been allowed in court because he was intoxicated on methamphetamine at the time.
John Sakrekov entered a conditional guilty plea to being a felon in possession of a firearm, which allowed him to appeal the denial of his motion to suppress evidence. On Thursday, the 8th U.S. Circuit Court of Appeals upheld the trial judge’s ruling.
Sakrekov argued that his statement should have been suppressed, as should have results of a search of his residence. The appeals court said Sakrekov didn’t prove his intoxication claim, and that Bentonville police followed proper search protocols.
