Appeals court overturns drunk-driving ruling

The Arkansas Court of Appeals says that weaving within a lane of traffic isn’t enough reason for an officer to pull someone over on suspicion of drunken driving.

The court made the ruling Wednesday in an appeal filed by a Carroll County man who was convicted of driving while intoxicated. Heath Corey Ford pleaded guilty to the charge but reserved the right to appeal, arguing that a deputy did not have probable cause to pull him over on U.S. 62 in 2009.

Deputy Joel Hand noted that Ford’s truck was weaving between the dotted white lane on the left and a curb on the right. The appeals court ruled that there was no probable cause to stop Ford because he didn’t drive outside the boundaries of his lane.
