HIV discrimination case settled

A federal judge has dismissed a lawsuit that accused a North Little Rock retirement community of violating civil rights laws by evicting a resident because he was HIV-positive, after a settlement was reached in the case.

Records for the U.S. District Court of Eastern Arkansas show the suit filed by Lambda Legal on behalf of Robert Franke was dismissed Wednesday.

Lambda Legal said in a news release that the dismissal followed a settlment reached with Fox Ridge, an assisted living facility. Terms of the settlement were not disclosed.

The suit, filed in May 2009, claimed that Fox Ridge evicted Franke, 76, the day after he moved in.
