Mental evaluation still pending in Everton mayor shooting

— A hearing set Friday for a man accused of shooting the mayor of Everton has been delayed because a mental evaluation isn’t complete.

Justin Bates was due in Boone County Circuit Court, but the Harrison Daily Times said the hearing was delayed because a report on Bates’ mental health isn’t ready.

Authorities say Bates shot and wounded Everton Mayor Bill Gerdes (JUR’-dihs) in June. Bates had been convicted of second-degree murder in 2000 and was released from prison last year after Gerdes wrote a letter on his behalf.

Bates pleaded not guilty to attempted capital murder and weapons charges in the more recent case. He was sent back to prison during the summer.
