No criminal charges filed in Maumelle tub death

— State prosecutors have determined that no criminal charges will be filed in the September 2011 case of a Mountain Pine man found dead in the tub of a Maumelle home.

The Maumelle Police Department released a supplemental narrative containing evidence which led police and Pulaski County Prosecutor Larry Jegley to determine the death of 24-year-old Dexter Williams was not a homicide.

A medical examiner determined in late September that Williams died from asphyxia, or a lack of oxygen. Drugs were also found in his system.

Former Little Rock weatherman Brett Cummins was found along with Williams in an unfilled hot tub on Labor Day. Williams was wearing a chain around his neck that looked like a dog collar. Investigators found traces of blood, but no water, in the tub.

Authorities interviewed Cummins, who resigned from KARK following the incident, along with his friend Christopher Barbour, who lives at the home in Maumelle.

Barbour told police that Cummins had come over the night before with Williams. He said Cummins and Williams then began drinking and using illegal drugs, an incident report said.

Barbour reportedly told investigators all three men went into the hot tub, but that he left around 11 p.m. The next morning, Barbour heard Cummins snoring and then saw both he and Williams were still in the tub, which had no water in it, according to the report.

"After Brett awoke they discovered that Dexter was unconscious and his face was a different color," police wrote in the report. "He then explained that Brett screamed and became ill and left the bathroom and vomited on the carpet in the living room."

Cummins was not at the home when police arrived Monday morning, but he later returned and provided a statement, police said.
