Arkansas high court allows adult ordinance challenge

— A sexually oriented business in Clarksville can challenge a city ordinance that the store says violates its constitutional rights.

The Arkansas Supreme Court on Thursday reversed a circuit judge’s dismissal of a challenge to the ordinance by the X-Mart Adult Superstore along Interstate 40.

The ordinance places a number of restrictions on how the business can operate and was passed in 2006 — just weeks after X-Mart opened its doors.

The Southwest Times Record reports the ordinance gave an existing business three years to comply. X-Mart got a six-month extension. After that expired, the city sued to close the store. The store filed a counterclaim, arguing the ordinance was unconstitutional.

The high court sent the case back to Johnson County Circuit Court.
