Two suspected accomplices of a vehicle break-in suspect fatally shot by police are being held on capital murder charges tied to the death.

Roy Lee Boles, 18, and Gary Garnett Coleman Jr., 21, made initial video appearances in Little Rock District Court Friday, during which innocent pleas were entered and both were ordered held without bond.

Acting Judge Blake Byrd noted during the proceeding that the two can be charged with capital murder even though police actually shot and killed the third suspect, 18-year-old Kenzell Hobbs.

"There is a provision in the law for criminal liability for homicide when a co-defendant is shot in the course of the crime," he said.

Boles was arrested when police went to a North Pierce Street apartment complex to investigate the auto break-ins and found him hiding in a bush early Thursday morning.

Two other suspects fled, prompting a search of the area that had area schools locked down for hours. The search ultimately led to University Avenue and H Street, where police said an exchange of gunfire between an officer and Hobbs resulted in Hobbs being shot in the upper torso. The officer wasn't hit.

Hobbs died less than two hours later at UAMS Medical Center.

Later Thursday, authorities took Coleman into custody. Prosecutors said during his hearing Friday that he gave a post-miranda statement indicating he was with Boles and Hobbs.

In addition to the murder charges, Boles and Coleman also each face charges of theft by receiving and breaking or entering an automobile. Boles is also charged with fleeing.

Both men were booked into the jail around 10 p.m. Thursday.
