Jonesboro officials want police-car shooting suit dismissed

JONESBORO — Lawyers for a northeast Arkansas city are asking a federal judge to dismiss a lawsuit from the mother of a young man who authorities say fatally shot himself while handcuffed in the backseat of a police car.

Chavis Carter's mother, Teresa Rudd, filed a wrongful death lawsuit against the city of Jonesboro, its police chief and two officers last month.

Attorneys for the city and police filed a response to the lawsuit in federal court on Thursday.

Police in Jonesboro have faced criticism since they said officers searched Carter twice but didn't find a gun before they noticed him slumped over and bleeding in a patrol car on July 28, 2012.

An autopsy said Carter shot himself in the head while he was under the influence of meth.

From all published reports this appears to be a "bogus" lawsuit! I would hope the plaintiff gets absolutely nothing, which is exactly what they deserve! Also, we need a "loser pays" law in Arkansas. If the plaintiff does not win, they and their lawyer(s) are responsible for all costs incurred by the defendants including all their attorney's fees and expenses!

Son in police custody, son shoots self.... and you call this bogus? OOooo That is right, JPD investigated it, so it is all good...NOT. It needs to be seen in the eyes of a jury!

Any shooting while someone is in police "custody" should be investigated fully... And if the police can't investigate it themselves then leave it to the courts to decide... Bad behavior should not be shoved under the rug...

I believe this was investigated by the FBI and they came to the same conclusion at the JPD investigation. And On August 20, 2012, the Arkansas crime lab ruled the death as a suicide. So, I don't think this was a local police white wash.
