Malvern man arrested on child porn charges

Authorities say a Malvern man was arrested this week after investigators discovered child pornography on his cell phone.

The Bryant Police Department said in a statement that 25-year-old Justin Brown was being questioned Tuesday in an unrelated incident when police found explicit photos of young girls on his phone.

Brown was charged with two counts of possession of child explicit conduct and use of a communication device to commit a crime. He was later released in lieu of a $10,000 bail.

Police say they are continuing to investigate.

so what exactly gave them the right to search his phone? I'm not saying this guy wasn't doing wrong but "being questioned for something is not grounds for being searched. I bet we hear later this gets tossed out.

The police routinely inspect photos, videos, texts on cell phones and can use a device that allows the information to be downloaded to a computer. This process can be used to catch drivers texting while driving as well as a whole host of other illegal activities. Isn't technology grand!!

AMENDMENT IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The individual's alleged crime notwithstanding, this article reads as though this person's phone was unlawfully seized and then unlawfully searched.

Like hell will cops ever search my phone. I will be eating an SD card in a heart beat and stomping on a phone. But then again, I really don't do anything much illegal.

MenLR2 will be guilty of destruction of evidence and obstruction of justice.
America, the land of the free? Nah, the land of the oppressed. Every breathing soul in America is guilty of some crime. There are so many hundreds of thousands of laws and regulations that NO ONE, not a single person can know and understand them all, much less avoid breaking one. This is what you have when lawyers get to make law. They're boinking their sister, it seems to me.

This situation is VERY well known and understood. LOTS of behavior studies to indicate that what stems from situations like this (too many laws, regulations, policies) is a general disregard for rules overall and a tendency to pick and choose among what rules will be obeyed, based on factors other than the existence of rule itself.
