Texas Guard refuses to process same-sex couples' benefits

AUSTIN, Texas — The Texas National Guard is refusing to process requests for benefits submitted by same-sex couples because of the state constitution's definition of marriage.

The American Military Partner Association gave a letter to The Associated Press on Tuesday that was written by Maj. Gen. John Nichols, the commanding general of Texas Military Forces.

Nichols writes that the Texas Constitution defines marriage as between a man and a woman, so his state agency cannot process applications for benefits from gay and lesbian couples. He recommends service members go to a federal installation to apply.

Nichols says he must order his forces not to accept benefit applications because there's a conflict between Department of Defense policy and Texas law.

Tuesday is the first working day gays in the military may apply for benefits.

@HM2: The problem is when "lawful orders" (i.e., anything other than genocide, crimes against humanity, war crimes, etc.) come from Washington, THAT is what the military must go by -- no matter what the state constitution says. (Sorry, but the military defines "genocide" and "crimes against humanity" along the lines of Auschwitz, *NOT* SSM.) Same reason the Fort Hood gunman's "defense" flopped -- personal religious belief does NOT make "lawful orders" unlawful enough to ignore them (much less murder servicemembers following them, whether it was "terrorism" or not).

HM2.......I get so tired of hearing "what's right" is ignoring the law. Being a radical fundamentalist doesn't get you special privilege under the law in a country where all are created equal. Even though I disagree politically with the wingers, I have had to give them credit for supporting the troops. Using a lame excuse to vent their homophobia and bigotry on our military heroes is vile.
