Bull Shoals chief ordered to live with town's mayor

By The Associated Press

This article was published April 11, 2014 at 6:36 a.m.

BULL SHOALS — An Arkansas police chief arrested on federal charges of using excessive force is free from jail — as long as he lives with the town's mayor.

That's according to an order from a federal magistrate setting conditions for release of Bull Shoals Police Chief Dan Sutterfield. The FBI arrested Sutterfield on Monday on charges of using excessive force and falsifying a report in the July 2013 arrest of Nicholas Dore.

U.S. Magistrate James Marschewski on Wednesday released Sutterfield into the custody of the town's mayor, Bruce Powell.

Powell tells The Baxter Bulletin that Sutterfield is allowed to visit his family but he must spend each night at the mayor's house.

Sutterfield remains employed by the Police Department but is not allowed to carry a weapon as terms of his release.

This is nuts, grant you he is innocent until proven guilty in a court of law. But allowing him continued access to the police department, even un-armed makes no sense to me. He should be placed on administrated leave, until this matter is resolved in court. As to whether he receives pay during this period, I would defer to the applicable statute regarding maters such as this, and if it is lawful for him to be paid, then the citizens of Bull Shoals should decide the issue.

Arguing over access to the police department? What about having to LIVE with the mayor? That's just plain stupid.
