Trademark board rules against Redskins name

WASHINGTON — The U.S. Patent Office has ruled the Washington Redskins nickname is "disparaging of Native Americans" and that the team's federal trademarks for the name must be canceled.

The ruling announced Wednesday comes after a campaign to change the name has gained momentum over the past year.

The decision by the Trademark Trial and Appeal Board is similar to one it issued in 1999. That ruling was overturned in 2003 in large part on a technicality because the courts decided that the plaintiffs were too old.

The new case was launched in 2006 by a younger group of Native Americans. A hearing was held in March 2013.

Just like last time, the Redskins can retain their trademark protection during an appeal.

Does't technically mean very much. Having a federally registered trademark provides some additional protections to the holder, but there are common law and state trademark laws that apply regardless of registration. Also, to the extent that losing the registration does make any direct difference, it would be to let others use the "Redskins" name too. Ironic, huh?

"Redskins" probably is the most egregious of these names, though. Unlike the Arkansas State Indians, whose nickname was endorsed by the Cherokee Nation. But it had to go, proclaimied the NCAA, from its headquarters in Indianapolis, Indiana.

The football team's name "Redskins" originated with a hot dog. A large weiner logo would apply more to federal agencies with, as map51 says, nothing better to do. Some group last year claimed a popular restaurant chain was racist because of the word "Cracker."
