LITTLE ROCK — Opponents and supporters of Arkansas' ban on gay marriage are sparring in court filings over whether the state's constitutional amendment barring same-sex marriage serves a legitimate purpose and can be challenged at the state level.

Attorneys for the state and a group of same-sex couples filed competing arguments in Pulaski County court Wednesday seeking summary judgment over the challenge to a constitutional amendment voters approved in 2004 defining marriage as between a man and a woman.

A hearing is scheduled April 17 over the motions.

Attorneys for the state and the Faulkner County clerk argued in part that opponents can't challenge the ban in state court since it's enshrined in the Arkansas constitution. Opponents argue the ban violates the equal protection guaranteed under the constitution.

    @Populist - "The arguments against polygamy do not apply." Why not? The "B" in the GBLTQ equation refers to people who are ostensibly sexually attracted to other people of any and all sexes, natural or otherwise. Why should these people (B's) not be allowed to have multiple spouses of various gender? Either you support marriage equality or you don't or you are a hypocrite. So, Pop, was most of the country right back in the day when they supported the doctrine of separate but equal? "Most" doesn't always equal "right", does it, Pop?

    @23Cal - There are more "compelling reasons" why state sanctioned marriage should be limited to one biological man and one biological woman that you probably already know. Conversely, what's the compelling reason to make a mockery of the institution of marriage just to satisfy the lifestyle choice of less than 1% of the nation's population? Shouldn't that question be the crux of the argument?

    Disappointing, but not unexpected. My soon-to-be husband and I have our work cut out for us when we move (back, in my case!) to Little Rock this summer. We'll not let the troglodytes define this beautiful state yet again. 1957 was horrific enough.
