Little Rock police have interviewed and released a man who they say fatally shot his brother after being threatened with a knife.
Fred Lee Mosby Jr., 35, who had been sought by police in the shooting and who surrendered about 9 p.m. Tuesday, gave a statement and was released without charges, Little Rock Police Department Lt. Sidney Allen said Wednesday. The file will be sent to the prosecutors' office for review to determine whether Mosby's use of force was justified and whether charges will be filed, Allen said.
About 1:45 a.m. May 6, Rhonda Mosby, 38, called police and said her husband, Keith Mosby, 33, had just been shot by his brother, Fred Mosby, in the stomach at their apartment at 1912 Green Mountain Drive, according to a Little Rock Police Department report.
She told police that before the shooting, Keith Mosby had told her to go lie down because he was going outside their apartment to smoke an unspecified drug, according to the report. When he returned, he was shaking and pulled out a blue pocket knife, she told police. She jumped up and ran outside the apartment and hid from him in the bushes because she was scared he would hurt her, according to the police report.
Then, she told police, she heard one shot ring out from inside the apartment, and Fred Mosby and his girlfriend, Penny Wittenberg, 38, ran outside and to an apartment upstairs, the report states. Then Rhonda Mosby saw her husband lying on the floor with a gunshot wound in his lower abdomen, police said.
Wittenberg told police that she and Fred Mosby had just brushed their teeth and were heading toward bed when they were approached by Keith Mosby, who came at Fred Mosby with the blue knife as if about to cut him, so Fred Mosby pulled out a black handgun and shot him, according to the report.
Wittenberg and Fred Mosby ran out of the apartment "in shock," she told police. He told Wittenberg to "call the police and make sure his brother was OK," according to the report, before fleeing.
Keith Mosby was taken to Baptist Health Medical Center, where he was pronounced dead.
The death was Little Rock's 24th homicide this year.
