Arkansas lawmakers to discuss gay-marriage ruling

LITTLE ROCK — An Arkansas lawmaker says he'll ask his colleagues to pass a resolution urging the state Supreme Court to uphold a gay marriage ban and invalidate hundreds of marriage licenses issued to same-sex couples.

Republican Sen. Jason Rapert of Conway says he'll present the non-binding resolution to the Arkansas Legislative Council urging justices to reverse Pulaski County Judge Chris Piazza's decision striking down the state's gay marriage ban. Rapert says the resolution going before the panel Friday morning has at least 20 co-sponsors.

The resolution would express support for the 2004 constitutional amendment approved by voters defining marriage as between a man and a woman. Piazza struck down that ban and a 1997 law last week. Thursday, he expanded that decision to include all laws banning same-sex marriage.

Marriage is not the creature of any State. Rather, it was established by God in Paradise for our first parents, Adam and Eve. As we read in the Book of Genesis: “God created man in His image; in the Divine image he created him; male and female He created them. God blessed them, saying: ‘Be fertile and multiply; fill the earth and subdue it.’” (Gen. 1:28-29)

" Not every soda is a Coke....not every tissue is a Kleenex....not every copy machine is a Xerox...and none of these civil unions are a Marriage". So says the voters of this state by a 75% majority vote. It's one thing to grant legal status....it's another to extend social status. Arkansas voters said no to the social status. Forget the religious arguments, you can't win them in a country where God is a dirty word. But we can win the copyright infringement for the misuse of the word M A R R I A G E.

Some of you people missed the civics lesson which taught that we have a Constitution which guarantees some individual liberties which neither the legislative government nor a democratic vote of the people can take away. This is a legal question as to whether gays are a persecuted minority being denied equal protection of the law. Lawyers and judges can and have disagreed. However, the opinion in the community is that we should not treat gays disgracefully and the days of bullying them may be closing to an end. If they want to marry, let them. I don't understand so-called Christians who take pleasure in insulting and humiliating other people. It is contrary to everything that Christ tried to teach us. Let's all try to be a little nicer to one another.

My question is whether or not a state judge has the authority to overturn ANY state constitutional provision. Even if his ruling was based on the US Constitution (I haven't read the ruling), wouldn't it require a ruling by a federal judge, not a state judge?
