Case on Hot Springs water issue dismissed

HOT SPRINGS — A circuit judge says a measure that would have stopped Hot Springs from using DeGray Lake as a supplemental water source will not be on the November ballot.

Garland County Circuit Judge Marcia Hearnsberger agreed with Hot Springs officials who rejected the ordinance because of improper wording. Several residents tried to force an ordinance on the ballot that would have stopped Hot Springs from using water from DeGray Lake.

The city agreed last year to pay Central Arkansas Water $1 million for the rights to a 20 million gallon per day allotment from the lake, which would supplement the water the city already receives from Lake Hamilton.

According to The Sentinel-Record, the petition was rejected because it didn't include the phrase "Be it enacted by the people of."
