Authorities: Huntsville city attorney arrested on suspicion of DWI

Huntsville's city attorney was arrested early Thursday morning in Rogers on suspicion of driving while intoxicated, a Benton County Sheriff’s Office spokesman said.

Howard Cain Jr., 70, of Huntsville declined to comment on his arrest.

A deputy arrested Cain at 1:30 a.m. Thursday in Rogers, said Deputy Keshia Guyll, spokesman for the sheriff's office. Cain also was arrested on suspicion of speeding and driving left of center, Guyll said.

Cain spent about five hours in the Benton County jail before he was released at 6:30 a.m. with a promise to appear in court, Guyll said. A court date was set for 9 a.m. Oct. 28 in Rogers District Court.

Huntsville Mayor Kevin Hatfield was not aware of the arrest. Hatfield said the city attorney is an appointed position.

Cain has served as the city attorney for 40 years, according to the city website.
