• Attorneys involved in a lawsuit over a proposed constitutional ban on gay marriage filed their second round of written legal arguments with the Arkansas Supreme Court on Monday, disputing the context and definition of the term "marital status." The Arkansas chapter of the American Civil Liberties Union filed a lawsuit last month contending that Proposed Amendment 3, the Arkansas Marriage Amendment, is vague and nonsensical and should be removed from the Nov. 2 ballot. Supporters of the amendment say it is clearly written and that the ACLU is merely trying to deny voters a chance to vote on the ban. The proposed amendment would define marriage as the union of one man and one woman. It also provides: "Legal status for unmarried person which is identical or substantially similar to marital status shall not be valid or recognized in Arkansas."
