TULSA — A 73-year-old Tulsa County volunteer deputy who shot and killed a suspect after mistaking his handgun for a stun gun is expected in court.
Robert Bates is scheduled for his first hearing Tuesday in district court.
Bates has been charged with second-degree manslaughter in the April 2 death of Eric Harris. Harris died after running from a sting operation involving illegal gun sales.
Bates is out of jail on $25,000 bond and his attorneys have said their client intends to plead not guilty.
An attorney for Harris' family said Monday that the sheriff's office violated a number of its internal policies by letting Bates carry his personal handgun after training at the range on another weapon.
