Siloam Springs man placed on probation in solicitation case

BENTONVILLE -- A judge placed a Siloam Springs man on five years of state-supervised probation after he admitted he used Facebook to try and get photographs of two teenage girls.

Jesus Guerra, 20, pleaded guilty Monday to engaging children in sexually explicit conduct for use in visual or print medium, a Class B felony; and criminal attempt engaging children in sexually explicit conduct for use in visual or print medium, a Class C felony. The plea was under an agreement Stuart Cearley, chief deputy prosecutor, reached with attorney Scott McElveen.

Guerra was arrested Oct. 16, 2014. The father of a 15-year-old girl reported to Siloam Springs police his concern about Guerra communicating with his daughter, according to a probable cause affidavit.

Cearley told the court Guerra solicited nude photographs from a 13-year-old girl and a 15-year-old girl.

Guerra requested the older girl send him a nude photograph, and the girl sent one of her in her underwear, according to a probable cause affidavit.

Guerra later threatened to post the photograph on Facebook if the girl didn't meet him, according to court documents.

Guerra admitted to police he also solicited a nude photograph from a 13-year-old girl, and she sent him the image, the affidavit states.

Circuit Judge Robin Green accepted the plea agreement and Guerra's guilty pleas.

Guerra was also sentenced to 120 days in the Benton County Jail, but he received credit for 201 days that he already had spent in custody.

He will be required to register as a sex offender, and he must participate in the sex offender treatment program at Ozark Guidance in Springdale.
