Prosecutor says state won't seek death penalty in shooting at Arkansas apartment

TEXARKANA — The Miller County prosecuting attorney says Arkansas won't seek the death penalty for a man charged in a fatal November shooting at a Texarkana apartment complex.

The Texarkana Gazette reported that 28-year-old Justin Johnson is charged with capital murder in the death of 22-year-old Trevon Staten. Johnson was arrested in April.

Authorities say Staten opened an apartment door for someone he knew. A probable cause affidavit says the man who knocked on the door didn't enter the apartment, but several masked men, one of whom investigators believe was Johnson, entered the apartment while shooting.

Johnson's attorney, Bill McClean, told a judge Tuesday that he and prosecutors didn't have some relevant documents from authorities.

The judge instructed McClean to notify his office if a meeting with Johnson leads him to question his competency to stand trial.
