Fort Smith police arrest one in shooting death of man, 33

FORT SMITH -- Police arrested Tuesday a suspect in an early morning shooting that left one man dead.

A police department shift summary said Arthur McIntyre, 33, was fatally shot about 2 a.m. in his home at 3001 Alabama Ave.

A news release from Fort Smith police spokesman Sgt. Daniel Grubbs said Denver Pennington, 29, was being held without bail in the Sebastian County jail in the shooting after being interviewed by police detectives. Initially, Pennington was arrested in Alma on Tuesday afternoon on a warrant alleging possession of a firearm by a felon.

Just after the shooting, police talked to two people at the scene, the shift summary said. One witness, Alexander Parrett, 26, told police he was standing next to McIntyre when he was shot. Parrett was too drunk to give any information useful to the investigation until later in the day, according to the summary.

Parrett told police he was sleeping when two men and a woman arrived at the house. He said McIntyre woke him up because he was angry about visitors being there and wanted Parrett to make them leave.

Grubbs said in the release that one of the three visitors was Pennington and that he and McIntyre got into an argument. The argument escalated as Pennington was leaving the home, and McIntyre was shot at least once with a rifle. His body was found outside the house near the back door of the residence.

Pennington and the other man and woman left the scene in two cars, the release said.
