Samuel Robert Hill, 27, is accused of killing Allen Hill, 61, at the elder Hill's house on Whitehouse Road near Elkins the night of Aug. 20, 2014.

Hill's trial had been set for Monday in Washington County Circuit Court, but it has now been reset for May 16 because of scheduling problems.

Hill has pleaded innocent to charges of capital murder and aggravated assault on a family or household member. A psychological exam at the State Hospital found Hill competent to stand trial.

According to police reports, Samuel Hill is accused of going to his parents' home and shooting Allen Hill, then leaving, only to return a short time later to fire more shots into the house.

Allen Hill was shot multiple times in the chest, said Kelly Cantrell, spokesman for the Washington County sheriff's office. Hill died at Washington Regional Medical Center in Fayetteville.

Roberta Hill told police her son shot her husband during an argument at their home. Fayetteville police arrested Samuel Hill about an hour later at his home.

He was treated at the hospital for a gunshot wound to his hip, which he received in the altercation with his father, according to an arrest report.

Samuel Hill is being held at the Washington County jail. No bail has been set.

If convicted of capital murder, Hill faces life in prison without the possibility of parole. Prosecutor Matt Durrett said prosecutors would not seek the death penalty, the only other possible sentence for capital murder.
