FORT SMITH -- Receipt by United States Marshal J. H. Parker yesterday of a subpoena for Guy Hartman, a defendant in the moonshine conspiracy of the Rush Distilling Company, to appear in the United States District Court at Asheville, N. C., on December 4, is believed to be a confirmation of the report that Hartman confessed when he was secretly released from jail here 10 days ago on $5,000 bond.

Sept. 18, 1966

• Federal Judge Oren Harris said Friday that the right of children to attend a nonsegregated school "is not dependent upon federally financed programs," but is an "inherent right" based on the United States Constitution. The judge addressed his remarks to the New Edinburg School Board but made them broad enough so they would apply to any school board that has elected not to comply with the 1966 desegregation guidelines of the United States Office of Education.

• The city of Sherwood has decided not to take Donrey Outdoor Advertising Co. to court following the removal of a billboard pole that allegedly violated a local ordinance. Sherwood City Attorney Bob Dawson said he decided Monday to withdraw the charge against Donrey -- for failure to get a building permit -- because the company removed the pole at Warden and Wadley roads Aug. 28, three weeks after being cited for another violation. Two days after the incident Aug. 7, businessmen Jimmy Tice and Walter Koehler were granted a preliminary injunction in Pulaski County Chancery Court halting Donrey from erecting a billboard near their businesses.

• Area hospital officials who've been in talks about expanding the reach of Arkansas Children's Hospital say Northwest Arkansas' greatest medical sub-specialty need for children is pediatric cardiologists. Little Rock-based Children's Hospital, the only hospital in the state that primarily serves children, has been brainstorming with hospital officials in Benton and Washington counties for about a year on how to expand its clinical services to Northwest Arkansas. On Sept. 5, the effort got an assist when the hospital announced John and Karen Flake would donate $1 million to help develop "an Arkansas Children's Hospital facility" in Northwest Arkansas.
