• Prosecutors are dropping a disorderly conduct case against Paul Simon and his wife, Edie Brickell, stemming from a fight at the couple's home. The 72-year-old Simon and 48-year-old Brickell had been scheduled to be in court Tuesday, but they did not appear. Prosecutors told a judge they were declining to pursue the case, meaning the charges will be dropped and erased after 13 months. The couple fought April 26 inside a cottage on their property in New Canaan, Conn., police said. Brickell told officers she confronted her husband after he did something to "break her heart," according to police, but she did not provide any details. She told police Simon shoved her and she slapped him. The report says Simon suffered a superficial cut to his ear and Brickell, who smelled of alcohol, had a bruise on her wrist. Simon is a 12-time Grammy winner and member of The Songwriters Hall of Fame and the Rock and Roll Hall of Fame -- as half of the duo Simon and Garfunkel and as a solo artist. Brickell is perhaps best known for the song "What I Am," recorded with her band the New Bohemians and released in 1988. The singers married in 1992. They have three children.

• Comedian Tracy Morgan, who was gravely injured in a crash more than a week ago, has been upgraded to fair condition, his publicist said Monday, calling it a "great improvement." Morgan, 45, a former cast member of Saturday Night Live and 30 Rock, had been in critical condition after a six-vehicle accident on the New Jersey Turnpike on June 7. He sustained several injuries, including a broken leg, a broken nose and several broken ribs. "His personality is certainly starting to come back as well," his publicist, Lewis Kay, said in a statement. Morgan was injured when a Wal-Mart truck slammed into the back of the luxury van in which he was a passenger as he was returning to New York City from a comedy show in Delaware. Another comedian, James McNair, known as Jimmy Mack, died in the crash, and two other comedians and Morgan's assistant, Jeff Millea, were injured. Millea's condition has also been upgraded from critical to fair, Kay said.
