Adult store trying to open in Arkansas sues city after being denied permit

by Rachel Herzog | February 15, 2018 at 4:11 p.m.

An adult store franchise trying to open in Arkansas is suing after the city denied the business a permit because its planned location was too close to a church, court records show.

Adam and Eve Jonesboro LLC states in its suit filed Monday that the business was granted a license to operate at 1518 S. Caraway Road in 2017 but was informed by the city attorney that the store requires a conditional use permit based on the location.

The city said the store does not meet a distance from churches, daycares and residential areas required by state law, according to the suit. There are two churches within a five-minute drive of the business's planned location.

Adam and Eve stores sell products including lingerie, adult apparel, costumes, bachelorette supplies and other novelties. The suit argues that the business does not fit the state law's definition of an adult bookstore or video store.
