The former Little Rock police officer who shot and injured a man suspected of shoplifting and robbing a woman of her car in July was arrested on a third-degree battery charge Tuesday morning.

An arrest report shows that Ralph Breshears, 56, was taken into custody shortly before 10 a.m. He was released on his own recognizance from the Pulaski County jail about an hour later, records show.

A warrant was filed for Breshears' arrest Monday, Arkansas Online reported.

The Pulaski County prosecuting attorney office's investigation into Breshears' shooting of 23-year-old Rudy Avila determined the former officer was "negligent" in his actions, according to a news release from police.

Breshears was a 26-year veteran of the Little Rock Police Department and retired in December, the agency said.

    Begin typing here... Avila is a heroin junkie in and out of the criminal justice system since 15 or so. A real POS. The cop should be reprimanded for not killing Avila, IMHO.

    So sad!! If Ralph Breshears had not shot the guy there is no telling how many more people might have been hurt or killed!! I was having lunch with friends at Le Madelines that day and it was a very scary scene. Rather than being arrested he should be given a medal.
