Control group

It's getting more expensive to live in parts of Arkansas, especially northwest Arkansas, and one state senator thinks the solution is government.

State Sen. Bart Hester (R-Cave Springs) has filed SB170, which seeks to stop cities and counties from regulating elements of building design. Here's more from the papers:

"The bill would prohibit cities and counties from regulating 'residential building design elements' defined as exterior building color; type or style of exterior cladding material; style or materials of roof structures and roof pitches; exterior nonstructural architectural ornamentation; location, design, placement, or architectural styling of windows and doors, including garage doors and garage structures; the number and types of rooms; the interior layout of rooms; and the minimum square footage of a structure."

The Republican cited a problematic rise in home prices as one reason this legislation is necessary, but that opens its own can of centipedes. The free market is involved here. It should determine prices for goods and services, including home sales.

Another problem with this legislation is that it takes control away from locals and gives it to lawmakers. The most effective government is almost always going to be the one closest to the voters. If Fayetteville decides on burdensome building regulations, voters can choose to elect different members of the city council, who could undo those regulations. They don't need someone in Little Rock making those decisions.

While higher housing prices can be a pain, consumers can settle the issue by voting with their feet. If enough people choose to move to West Fork because of high home prices in Fayetteville, eventually the city will see the light and correct its course.

Local government might make some silly decisions and want all pink houses next to the interstate, but that's the right of cities and counties. Regnat populus! Our state has 75 counties and 502 incorporated cities. Take your pick.
