Attorney general files lawsuit against Arkansas photography company

The Arkansas attorney general has filed a consumer-protection lawsuit against a photography company that failed to deliver portraits to customers, according to a news release.

The Attorney General's Office found that at least 13 people had purchased photo packages from Jonathan Funk Photography, which advertised newborn and special event photography in local Arkansas magazines, the release states.

Customers paid between $1,000 and $2,000 after their sessions but never received their portraits, Attorney General Leslie Rutledge's office said. Some victims reported attempting to retrieve their purchase for up to a year without success, according to the release.

“Arkansans paying for services expect to get what they pay for,” Rutledge said. “Jonathan Funk Photography willfully chose to deceive and violate the trust of many Arkansans, and I will continue to prosecute companies that take advantage of Arkansans’ hard-earned money.”

Rutledge said the photography company violated the Arkansas Deceptive Trade Practices Act, which carries penalties up to $10,000 for each violation.

In the suit filed Friday, she is asking the court to impose civil penalties and restitution for the affected consumers.
