Prosecution, defense rest cases in Smith trial

The prosecution and defense have rested their cases Monday in the seven-week drug conspiracy trial of Anna Nicole Smith’s lawyer-boyfriend and two doctors.

The defense rested without calling any witnesses or asking the three defendants to testify in their own defense.

Prosecutors called a long parade of witnesses since testimony began in early August.

The judge scheduled closing arguments for Thursday and planned to rule on dismissal motions before then. He has indicated he will likely throw out some charges.

Howard K. Stern, Dr. Sandeep Kapoor and Dr. Khristine Eroshevich have pleaded not guilty to conspiring to provide excessive opiates and sedatives to Smith, who is described in the charges as an addict. They are not charged in her 2007 drug overdose death in Florida.
