Oklahoma prosecutors seek death penalty for Arkansan

FORT SMITH — Two brothers from Arkansas now both face a possible death sentence in Oklahoma in the death of a Fort Smith woman.

The Times Record reported that Le Flore County District Attorney Jeff Smith filed a bill of particulars Wednesday in district court in Poteau, Okla., saying he plans to seek the death penalty for 25-year-old Elvis Thacker if Thacker is convicted of first-degree murder in the September 2010 death of Briana Jane Ault.

Smith said in March that he would seek the death penalty for Thacker's brother, 25-year-old Johnathen Thacker, in Ault's death.

The Cedarville, Ark., men are charged with first-degree murder and sodomy in Ault's death. Both have pleaded innocent.

Ault's body was found in a pond in Pocola, in eastern Oklahoma, with her throat cut.
