Man charged with shooting at police officer gets new trial date

FAYETTEVILLE -- A man police say shot at an officer during a standoff at a motel had his case reset Monday in Washington County Circuit Court.

Bryan Durbin, 42, of 1555 Martin Luther King Blvd. in Fayetteville was arrested Sept. 8 and is charged with attempted capital murder and terroristic threatening. Durbin's address listed at the Washington County Detention Center is the Seven Hills Homeless Center.

Durbin is charged with attempted capital murder because he shot at an officer, according to police. Durbin's case was reset to March 14. The delay is because of a mental examination requested by the defense to determine if Durbin is competent to stand trial.

Police went to Room 130 at the Motel 6 at 2980 N. College Ave. where they heard a disturbance in the background, according to police records.

Durbin used a gun to threaten his girlfriend, Teresa Lynn Johnson, 45, according to police documents. He told police he wanted to die, was intoxicated, and had no place to go.

Durbin released Johnson. Officer Daniel Plume was against a wall on the west side of the motel when Durbin aimed his weapon at him and fired one round, according to the report. Plume was not injured.

Durbin barricaded himself in the room and he negotiated with police for the next four hours.

The motel was evacuated. Part of College Avenue was blocked because Durbin could have fired at traffic from his motel room, police said.

Durbin appeared to fall asleep on a bed while police talked with him, according to dispatch records. Plume arrested Durbin without incident.

Durbin is being held at the Washington County Detention Center in lieu of $15,000 bond.
