Panel upholds dismissal of license-plate-reader lawsuit

LITTLE ROCK — An appeals court panel has upheld a federal judge's decision to dismiss a lawsuit challenging Arkansas' restricting the digital collection of license plate data.

A three-judge panel of the 8th U.S. Circuit Court of Appeals on Tuesday upheld U.S. District Judge Brian Miller's dismissal of a lawsuit filed by two companies against the governor and attorney general. The firms challenged the constitutionality of a 2013 law banning the use of automatic license-plate readers by anyone other than law enforcement and parking enforcement agencies.

The law allows law enforcement to keep license-plate data for up to 150 days unless it's part of an ongoing investigation.

Miller dismissed the case last year, ruling the officials had sovereign immunity from the lawsuit.
