A waiter from Little Rock found innocent of molestation in 2012 has again been accused of a sexual offense involving an underage girl at a restaurant — this time at a North Little Rock Santo Coyote.
Marco Antonio De La Rosa, 40, was arrested Tuesday on a charge of sexual indecency with a child, according to jail records.
The father of an 8-year-old girl told police of information from his daughter that a Hispanic restaurant employee, identified by authorities as De La Rosa, had exposed himself to the girl between 5:30 p.m. and 6 p.m. Feb. 11.
The incident occurred in a hallway between the men’s and women’s restrooms at Santo Coyote, 2513 McCain Blvd., he said.
North Little Rock police said they were informed of the report about 2:13 p.m. Feb. 24.
Reached by phone, an employee at Santo Coyote in North Little Rock could not confirm De La Rosa's employment status.
In June 2012, a Pulaski County jury found De La Rosa innocent of molesting a then-7-year-old girl in February 2011 in the men's restroom of Casa Manana on Arkansas 10 in west Little Rock, the Arkansas Democrat-Gazette previously reported.
One of the key arguments made by the defense during that trial was that the girl could have misidentified her attacker.
Earlier that year, jurors were unable to reach a verdict in his first trial after six hours of deliberation, according to the newspaper.
The girl and her family were at Casa Manana on their way to a sports event. Shortly after learning that the girl had been molested, the group searched the restaurant and pointed to De La Rosa, who was found locked in the restroom, as the suspect.
De La Rosa was booked on his most recent charge about 3:54 p.m. Tuesday into the Pulaski County jail. Records show he remained at the jail as of Thursday afternoon.
